  1. Applicability of general terms and conditions

    1.1 These General Terms and Conditions apply to any and all sales and purchases that are in any way described, mentioned, promoted or listed in the Paul Lafayet catalogue and menu for the territory of the Hong Kong Special Administrative Region (“HKSAR”). Any terms and conditions not expressly included herein are excluded. By placing an order, the Customer accepts the General Terms and Conditions stated herein. Any delay or failure of Paul Lafayet to exercise one or more of its rights hereunder shall not be deemed a waiver of those or any other rights.

  2. Requests and confirmation

    2.2 No cancellations or changes will be accepted once an order has been made.
    2.3 Each order placed is subject to Paul Lafayet’s written approval and confirmation. Paul Lafayet reserves all its rights to reject any orders placed by reason of unavailability of stock, incomplete customer information, or for any other lawful reasons. We shall notify you within two (2) working days after having receiving your order if for any reason we are unable to fulfill and carry through with the said order. In such event, any payments made to us shall be refunded.
  3. Prices

    3.1 Unless otherwise noted, all prices and other charges stated are in Hong Kong Dollars (HKD) and are subject to change without notice.
  4. Payment at time of order

    4.1 All purchases and/or orders placed are subject to an immediate non-refundable payment by cash, EPS or credit card (Visa and MasterCard are accepted).
  5. Product Availability

    5.1 The catalogue shows and lists all of the products that Paul Lafayet would offer. However, please note that the products shown and listed are subject to availability. Paul Lafayet reserves its rights, in the event of the unavailability of an item(s), to substitute an item(s) of equal value with customers’ consent.
  6. Delivery of Products

    6.1 Product Delivery

    • 6.1.1 Once we accepted your order, preparation of the said order will commence and arrangements for delivery will be made. While all efforts will be made to ensure prompt delivery of your order, please note that we shall not be liable for any loss due to your failure to accept delivery at the location, time and date specified in your order.
    • 6.1.2 Inspection of the products must be conducted upon receipt of the delivery. The customer shall bear all risks for any loss, damage and/or deterioration of the product upon such receipt.
    • 6.1.3 Paul Lafayet shall not bear any responsibility in the event the customer does not receive delivery of the products due to the customer’s failure to provide with a correct delivery address.
    • 6.1.4 Paul Lafayet shall not bear any responsibility for loss, damage and/or deterioration of the products in the event the customer opts to authorize release of signature for delivery of the products.
    6.2 Non-Delivery due to Special Circumstances

    • 6.2.1 Paul Lafayet shall not be responsible for any delay or non-delivery caused by events beyond its control, including strikes, natural disasters or terrorism. All deliveries will be suspended during Typhoon Signal No. 8 and Black Rainstorm Warning. In such events, we shall notify customers to re-schedule the delivery as soon as possible.
  7. Transfer of Ownership and Risks

    Ownership of the products will only be transferred upon receipt of full payment on the order made. The risk of loss or deterioration will be transferred immediately to customers when the product is delivered to, and received by, the customers, the addressee or its agent.

  8. Comments and Complaints

    8.1 We highly value any comments and/or complaints. All complaints will be thoroughly investigated to ensure that the upmost care and highest quality of products are produced.
    8.2 All claims must be made within 48 hours of product delivery. Subsequent claims received by Paul Lafayet may not be accepted. Any complaints and/or claims shall be made to our Customer Service Department by email to the following email address: -


    8.3 A detailed written explanation and receipts, including the damage sustained, must be provided regarding any claim made. After looking into the claim, Paul Lafayet shall at its own discretion determine the appropriate remedy i.e. arranging a redelivery of the product.
    8.4 In the event that the products are damaged and are not of sufficient quality, Paul Lafayet shall permit for an exchange of the product free of charge. Upon acceptance of the said exchange by the customer, the customer hereby agrees to waive all claims against Paul Lafayet.
    8.5 For avoidance of doubts, Paul Lafayet shall not be liable for any special, indirect, incidental, punitive or consequential damages, including but not limited to, loss of profits, revenue or other benefits arising from or related to a breach of the general terms and conditions stated herein, or for claims against customers by any third party.
  9. Returns

    Once an order has been placed, no cancellation or change will be accepted and no refund will be made.

  10. Protection of Personal Data Privacy

    Paul Lafayet is committed to safeguard and protect the personal data collected from you during the course of business. All personal data collected will be solely be used for the purpose of following up on the purchase orders made by you and will not be used and/or passed to third parties and/or promotional purpose without first receiving your consent. The personal data collected would include the name, contact number, delivery address and credit card details (if payment is made online and/or by fax).

  11. Product Conservation

    Our products should be stored in a cool and dry place with temperatures between 0ºC to 5ºC.

  12. Trademarks, Copyrights and Restrictions

    All rights concerning the materials on the Paul Lafayet website and in its publications, including but not limited to the images, logos and illustrations, belong solely to Paul Lafayet. The contents shown and stated therein are provided for your personal, non-commercial use only. Such material may not be copied, republished, reproduced, uploaded, modified, or distributed in any way without the prior written consent of Paul Lafayet.

  13. Resale Not Permitted

    Products ordered from us are intended for the customers’ personal consumption only and shall not be resold unless otherwise agreed in writing by Paul Lafayet.

  14. Governing law and Jurisdiction

    The use of our website and our publications, the general terms and conditions herein stated and all transactions conducted shall be governed by the laws of the HKSAR and the parties concerned shall submit to the non-exclusive jurisdiction of the Courts of the HKSAR.
